Reservation Policies
1. SECURITY DEPOSIT: A security deposit of 10% of your reservation will be due at the time of booking; 10% Security Deposit will be applied to the total due.
2. RESERVATIONS: Renter(s) are aware that rental rate and security deposit must be paid in full to ensure reservation for requested date and time.
3. CANCELLATION POLICY: All reservations made are rain or shine. If cancellation is made with at least 7 days notice, Renter(s) will be refunded total rental amount less 20%. If cancellation is made with less than 7 days notice, Renter(s) will be refunded total amount of rental less 80%. If for whatever reason.
Renter(s) does not show up, no refunds will be made.
4. WEATHER: We value the enjoyment and safety of our guests. Boat rentals are rain or shine. In the event of a Warning (not watch) from the National Weather Service or Severe Weather, we will make every attempt to reschedule or refund (at Holiday Harbor's discretion) the time and length of the warning.
5. LATE RETURN: Rental period stated above is strictly enforced. If boat is not returned to Owner by time stated, Renter(s) agree to pay a late fee in the amount of $150.00 per hour. If boat is over 2 hours late and Renter(s) have not notified Owner, Owner will then consider the boat stolen and notify authority.
6. AVAILABILITY: Owner’s ability to provide boat for rental is contingent upon and subject to the return of the watercraft by the previous lessee in proper operating condition or for causes beyond the Owner's control. Owner agrees to make every effort possible in providing boat to Renter(s) at agreed upon time and date. Owner will refund all fees paid if unable to provide boat to Renter(s).
7. FUEL: At the start of the rental period, boat will be provided to the renter(s) with a full tank of gasoline. Renter(s) acknowledges and agrees that they are responsible for all fuel used in the boat. Renter(s) acknowledge and agree that if the boat is not returned witha full tank of gas that they will be responsible for the cost to return the fuel level to full. This amount will be deducted from the security deposit paid.
8. BOAT OPERATION: Renter(s) agree to be responsible for all operation of equipment and not to allow anyone else not listed on this agreement to operate. No person shall operate equipment under the influence of drugs or alcohol. Renter(s) will be responsible for the operation of the boat within all laws. Renter(s) agree not to allow no more than the number of people or max weight listed for such equipment at any one time. Personal flotation devices are required to be worn by all passengers 12 years old and younger at all times while riding on boat. The only approved tube is the one offered for rental. The use of any other tube will be unauthorized and the Renter(s) will be responsible for any damage.
9. REPAIRS / SERVICE CALLS: Renter(s) acknowledges and understands that Owner cannot guarantee against mechanical failures of the rental equipment. Renter(s) agrees to immediately notify Owner of defective or non-working units. Owner will make every reasonable effort to repair or replace defective units as quickly and efficiently as possible. Repair due to normal wear and tear on the equipment will be made by the Owner. Should a repair person make a call to repair or replace a unit that is found to be in working order and the problem was due to Renter(s) oversight or neglect or misuse, Renter(s) agrees that the repair call costs may be deducted from the Renter(s) security deposit. The down time for service calls and tows to marina, if caused by driver error, is forfeited until repaired.
10. DAMAGES TO EQUIPMENT: Renter(s) acknowledges and understands that equipment is to be left in clean, undamaged condition, in the same condition at commencement of the rental period. If rental equipment is not left in suitable condition, Renter(s) acknowledges and understands that Owner reserves the right to charge Renter(s) for any repairs, special cleaning, or for replacement of lost property. If such charges exceed the security deposit amount, then the Renter(s) will pay to the Owner in full immediately following notice the additional amount due. PLEASE BE AWARE: Major problems that can arise are few, but costly. For example, for damage to the lower unit of the boat, the Renter(s) could be held responsible for repairs upwards of $2,500.00. Replacement of boat propellers range in price upwards of $250.00.

11. ASSUMPTION OF RISK: I, the Renter(s), understand and am aware that boating, skiing, riding water toys are HAZARDOUS activities. |, the Renter(s), understand that the sport of boating, skiing, riding water toys and the use of the equipment involvea risk in injury to any and all parts of the user’s body and possible death. |, the Renter(s), hereby agree to freely and expressly assume and accept any and all risks in the use of the equipment rented
12. LIABILITY AGREEMENT: I, the Renter(s), hereby release from any legal liability, the Owner and agents from any and all liability for damage and injury or death to myself and or any person on property resulting from the selection, maintenance or use of this equipment, and for any claim based upon negligence, breach of warranty, contract, claim, or other legal theory, accepting myself, the Renter(s), the full responsibility for any and all such damages or injury which may result. It is understood and agreed that the Rental Fee is a presently earned fee for the use of the equipment and that the security deposit is a deposit against costs of repairs or cleaning that may be required as a result of physical damage to the equipment during the rental period or against any liability that | may incur to Owners pursuant to this agreement. Further, |, the Renter(s), am responsible for all damages and/or losses to the equipment or any of its contents during that period.
13. INSPECTION OF EQUIPMENT — Owner certify that the boat and motor are in good mechanical and physical condition. Any known damage or problems will be listed on the “Boat Check-Out Sheet”. Renter(s) will inspect said equipment and leases the same without any representations by Owner. If equipment has damage or problems not listed on the “Boat Check-Out Sheet”, Renter(s) must notify the Owner before use of the boat begins and on the first day of rental.
14. THEFT OR LOSS — In case of theft or loss, Renter(s) is responsible for the replacement value of the equipment. In case of abuse or damage, Renter(s) will be charged for the repair or replacement of the equipment.
I, the Renter(s) also agree not to exceed capacity requirements of the rented unit(s).
